Please read these Terms of Service (“Terms”) carefully before using the asean-estates.com website or engaging any services provided by ASEAN Estates (“we”, “us”, “our”). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

ASEAN Estates is a property investment and management agency operating in Medan, North Sumatra, Indonesia. Our services are governed by Indonesian law.

1. Services

ASEAN Estates provides the following services:

  • Property sourcing and investment consultancy — identifying and recommending investment properties in Medan, Indonesia
  • Property acquisition support — coordinating due diligence, legal representation, notary (PPAT) engagement, title transfer and tax compliance
  • Property management — tenant sourcing, rent collection, maintenance coordination and financial reporting
  • General advisory — information and guidance on Indonesian property ownership structures for foreign and local investors

Specific terms for each service are set out in separate service agreements or engagement letters provided at the time of instruction. These Terms apply to all interactions with ASEAN Estates unless superseded by a signed service agreement.

2. Website Use

By using asean-estates.com you agree that you will:

  • Use the website for lawful purposes only
  • Not attempt to gain unauthorised access to any part of the website or its systems
  • Not use the website to transmit unsolicited communications, malware or harmful content
  • Not reproduce, distribute or republish any content from this website without our prior written consent

4. Fees & Payments

Our fee structures are disclosed in our service agreements prior to engagement. General principles:

Property managementMonthly management fee as a percentage of gross rental income, set out in management agreement
Consultancy & advisoryAgreed in writing prior to commencement

All fees are quoted exclusive of Indonesian VAT (PPN) where applicable. Third-party costs (notary fees, BPN registration, government taxes including PPh and BPHTB) are payable directly by the client and are not included in ASEAN Estates agency fees.

5. Indonesian Law & Property Regulations

All property transactions facilitated by ASEAN Estates are conducted under Indonesian law, including but not limited to:

  • Undang-Undang No. 5 Tahun 1960 (Basic Agrarian Law — governing land titles including Hak Milik, Hak Pakai and HGB)
  • PP No. 18 Tahun 2021 (Government Regulation on land rights, apartment units and land registration)
  • UU No. 11 Tahun 2020 (Omnibus Law — covering foreign investment and PT PMA structures)
  • UU No. 7 Tahun 2021 (Tax harmonisation law — PPh Final and BPHTB on property transactions)

ASEAN Estates facilitates transactions in compliance with these laws but is not a law firm. Clients are responsible for obtaining their own independent legal advice. All title transfers are executed by licensed Indonesian notaries (PPAT) who hold independent professional responsibility for the transaction.

6. Intellectual Property

All content on asean-estates.com — including text, images, graphics, data, market reports, investment guides and ROI analyses — is the intellectual property of ASEAN Estates unless otherwise stated. You may not:

  • Copy, reproduce or republish our content without written permission
  • Use our content for commercial purposes without a licence
  • Remove or alter any copyright or attribution notices

You may share links to pages on our website and quote brief extracts for non-commercial purposes provided you attribute ASEAN Estates as the source and link back to the original page.

7. Limitation of Liability

To the fullest extent permitted by Indonesian law, ASEAN Estates shall not be liable for:

  • Any inaccuracy in market data, ROI projections or property valuations published on this website
  • Any loss arising from your reliance on information provided on this website without taking independent professional advice
  • Any delays, disputes or failures in property transactions caused by third parties (including notaries, government agencies or developers)
  • Any technical failure, interruption or error on our website

Nothing in these Terms limits our liability for fraud, wilful misconduct or any liability that cannot be excluded by law.

8. Third-Party Links

Our website may contain links to third-party websites including government agencies (BPN, DJP), legal references and market data sources. These links are provided for reference only. ASEAN Estates has no control over the content of third-party sites and accepts no responsibility for their accuracy, availability or privacy practices.

9. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising from these Terms or our services shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of Medan, North Sumatra, Indonesia.

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most current version. Continued use of our website or services after any update constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
